We kregen de slechtste online gokwetgeving van Europa en we maakten er het slechtste van.
Bravo Nederlandse politici, Bravo Nederlandse Ministeries en Bravo Nederlandse Kansspelautoriteit. Na meer dan tien jaar voorbereiding is het gelukt om in 2021 de stomste gokwet van Europa te maken. En Bravo Nederlandse gokindustrie, we hebben daarna er echt wel een zootje van gemaakt. Vijf redenen waarom ik denk dat dit misging. En hoe de weg naar boven kan beginnen!
1. Leve de EU (Niet!)
In de geest van de EU moest de nieuwe online gokmarkt er een zijn met vrije concurrentie. Dat betekent dat iedereen die de markt wil betreden, de kans moet krijgen om dat te doen. Geen beperkingen op het aantal licenties, geen extra (slimme) voorwaarden zoals in België en Zwitserland dat een licentiehouder ook een landgebaseerde licentie moet hebben, geen beperkingen. Wie wil komen kan zich aansluiten. Kom maar op! Dertig operators om 18 miljoen mensen te bedienen. Vrije concurrentie drijft... concurrentie, en daarmee Marketing! Duh!
2. Een ervaren en voorbereide regulator (Niet!)
De wet zelf is niet erg gedetailleerd. Hij is geschreven door mensen die wetten schrijven, niet door mensen die iets weten van gokken of aanverwante zaken. De interpretatie van de wet had een mooie samenwerking kunnen zijn, een dialoog tussen de toezichthouder, de industrie, de verslavingsexperts, de zorgsector. Dat is niet gebeurd. Er werd geen uitleg gegeven, geen instructies gegeven. De KSA gaf ruwe overzichten en dat was het. De industrie moest dat zelf uitzoeken en de KSA evalueerde en beoordeelde achteraf. Dus enorm veel werk voor advocaten, experts, consultants, allemaal hetzelfde wiel uitvinden terwijl ze de exacte specificaties van dat wiel niet kenden. De exploitanten hebben echt hun best gedaan, de meesten van hen zelfs hun uiterste best. Feedback via boetes of waarschuwingen, dat is een goede samenwerkingsomgeving... Pas dit jaar, 2026, hoorde ik op de Gaming in Holland-conferentie iemand van de KSA zeggen dat ze de dialoog met de industrie waren begonnen. Eindelijk, na bijna 5 jaar.
3. Een fatsoenlijk gedragende industrie (Niet!)
Hoe noem je het als de ergste dromen uitkomen en nog meer? Ik denk dat 'nachtmerrie' een understatement is. Oké, ze werden 'gedwongen' door een enorme investering in het licentieproces en het bestormen van de markt met twintig of meer operators, maar jeetje, wat hebben de eerste operators zich misdragen! Elke centimeter potentiële reclameruimte die was toegestaan, was in beslag genomen. Ik heb nog nooit zo’n take-over van reclame door een industrie gezien. Natuurlijk was een heel streng en veel te laat reclameverbod het enige dat kon volgen. Eigen-schuld-dikke-bult.
4. Een goed kader voor jongvolwassenen (Niet!)
Dit is het deel dat me het meest pijn doet. Hier hebben we collectief fouten gemaakt. De onwetende politici en de toezichthouder hebben geen goed kader gebouwd, de industrie keek weg of paste alleen toe wat ze verplicht waren om te doen. De geest kwam uit de fles. Te veel jongeren zijn (veel) te ver gegaan, terwijl dat voorkomen had kunnen worden. Als het aan mij lag, zouden we alle buitensporige verliezen moeten teruggeven. En met "wij" bedoel ik een gezamenlijke verantwoordelijkheid voor de exploitanten, de KSA, de media en de overheid. Iedereen die geld verdiende aan jongeren die niet zoveel hadden mogen verliezen, zou moeten bijdragen om hen terug te betalen. Dus ja, KSA en overheid, het is ook mede jullie schuld. Eigen-schuld-dikke-bult.
5. Een plek aan tafel (Niet!)
Om de een of andere reden verloor de gokindustrie haar plek aan tafel, waardoor iedereen iets te zeggen had, behalve wij. Eind 2025 heeft Kate Chambers hier al een artikel geschreven over de Britse markt en ik vind dat hetzelfde geldt voor de Nederlandse markt. De KSA begint pas na meer dan vier jaar KOA een dialoog met de industrie. De verhoging van de Gaming Tax in twee delen werd zonder veel weerstand geaccepteerd. De zorgsector is boos, begrijpelijk, over de getroffen jongvolwassenen en meer. De reclamebeperkingen hebben nog niet eens hun hoogtepunt bereikt. Wij, de industrie, praten niet mee. Er wordt over ons gesproken en beslist.
Laten we beginnen met echt Verantwoord Spelen
Is dit het einde van de gereguleerde sector? Misschien, als we niet veranderen. Voor mij ligt de oplossing in het creëren van een nieuwe positie voor ons. Gokken is leuk, zolang je binnen de grenzen blijft. Besteedbare tijd, besteedbaar budget, gebalanceerd aandeel in iemands leven. Dat zou de basis moeten zijn van onze bedrijfsstrategie en het begin van onze positionering en marketing. Zo krijgen we de plek die we zouden moeten hebben. Gokken is leuk, maar wel verantwoord.

We got the worst online gambling act in Europe and we made the worst of it.
Bravo Dutch politicians, Bravo Dutch Ministries and Bravo Dutch Gaming authority. After more than a decade preparation you were able to make a stupid gaming law back in 2021. And Bravo Dutch gambling industry, you were able to make it even a worse mess. Five reasons why I think this went wrong.
1. Long live the EU (Not!)
In the spirit of the EU the new online gambling market had to be one with free competition. That means that everyone who want to enter the market should have the chance to do that. No restrictions to the number of licenses, no extra (smart) conditions like in Belgium and Switzerland that a license holder should also operate a landbased license, no restrictions. Whoever wants to come can join. Come on! Thirty operators to serve 18 million people. Free competition drives… competition, and with that, Marketing! Duh!
2. An experienced and prepared regulator (Not!)
The law itself is not very detailed. It is written by people who write laws, not by people who know anything about gambling or related matters. The interpretation of the law could have been a nice cooperation, a dialogue between the regulator, the KSA, the industry, the addiction experts, the care sector. That didn’t happen. There was no explanation given, no directions made. The KSA gave rough outlines amd that was it. The industry had to find out for themselves and the KSA evaluated and judged, in retrospect. So tons of work for lawyers, experts, consultants, all inventing the same wheel whilst they did not know the exact specifications of that wheel. The operators really tried, most of them in their best effort. Feedback through fines or warnings, that is a good cooperative environment… Only this year, 2026, at the Gaming in Holland conference I heard someone from the KSA saying that they started the dialogue with the industry. About time, after almost 5 years.
3. A decent behaving industry (Not!)
What do you call it when the worst dreams come true and even more? I think ‘nightmare’ would be an understatement. OK, they were ‘forced’ by a huge investment for the license process and the upcoming flooding of the market with twenty or more operators, but boy, how did the launching operators misbehave! Every inch of potential advertising space that was allowed by regulations was taken. I have not seen such a take-over of advertising before. Of course a too-late-too-strict advertising ban was the only thing that could follow. In Dutch we say eigen-schuld-dikke-bult.
4. A good framework for Young Adults (Not!)
This is the part that hurts me the most. This is where we collectively f-ed up. The ignorant politicians and regulator did not put a good framework together, the industry looked away, or just applied what they had to do. And it let the genie out of the bottle.
Too many young people were hurt, whilst that could have been avoided. If it was up to me we should give all the excessive losses back to the people. And with “we” I mean a joint responsibility for operators, the KSA (you too!), media and the government. Everyone who earned money on young people that should not have lost their balls off should chip in to reimburse them. Eigen-schuld-dikke-bult.
5. A seat at the table (Not!)
For some reason the gambling industry lost its seat at the table with the resulted that anyone had a say, except for us. End 2025 Kate Chambers already wrote an article on this for the UK market and I feel the same applies for the Dutch market. The KSA only started a dialogue with the industry after more than 4 years of KOA. The Gaming Tax hike in two parts went down without much resistance. The care sector is angry, understandable, for the hurt young adults. The marketing restrictions have not even reached its peak. We are the bad ones, and for some parts, I think we deserve it.
Let’s start with real Responsible Gaming
Is this the end of the regulated sector? Maybe, if we do not shape up. For me the solution lies in creating a new position for us. Gambling is fun, as long as you stay in limits. Affordable time, affordable budget, affordable share in a person’s life. That should be the basis of our business strategy and the start of our positioning and Marketing. Gambling is fun, when done responsible.
